These Terms of Service (together with the documents referred to in it) tells you the terms of service on which you may make use of TAW Player (the “Service”). Use of the Service includes accessing, browsing, or registering to use the Service, and using the Service to download or stream content.
Please read these Terms of Service carefully before you start to use the Service. By using TAW Player, you confirm that you accept these Terms of Service and that you agree to comply with them. If you do not agree to these Terms of Service, you must not use the Service.
1.1. In consideration for the payment specified from time to time on The Anfield Wrap website (the “Website”) (the “Subscription Fee”) from you to The Anfield Wrap Magazine Limited (“TAW”), you will have access to all content available on the Service (a “Subscription”) which shall be provided in accordance with these Terms of Service.
1.2. A Subscription will last for the period specified on the Website from time to time (the “Subscription Period”). Your Subscription will terminate in accordance with clause 2.3 at the end of the Subscription Period.
2. Payment and cancellation
2.1. All payments will be made via PayPal or Worldpay.
2.2. Your Subscription will start on the date of the first payment (the “Start Date”).
2.3. Your Subscription will terminate at the end of the Subscription Period. TAW is not responsible for reminding you that your Subscription is due to expire, and shall bear no responsibility for any break in the Service resulting from a failure to take out a further subscription.
2.4. TAW may cancel your Subscription, or its provision of the Service, at its reasonable discretion.
3. Cooling off period
3.1. You have the right to cancel your subscription and to receive a full refund of any payment made up to 14 days after the Start Date.
4. Term and termination
4.1. Clauses 5, 7 and 10 shall survive termination of these Terms of Service.
4.2. With the exception of those clauses listed at clause 4.1, these Terms of Service will continue to apply to you until your subscription terminates in accordance with clause 2.
5. Licence and intellectual property
5.1. All content provided through the Service is the property of TAW.
5.2. TAW grants you a limited, non-exclusive, revocable licence to download or stream content through the Service for personal, non-commercial use only (your “Licence”) during the Subscription Period.
5.3. You shall not assign or sub-licence your rights under the Licence.
5.4. Your Licence does not permit you to:
- 5.4.1. copy;
- 5.4.2. reproduce;
- 5.4.3. republish;
- 5.4.4. post;
- 5.4.5. broadcast; or
- 5.4.6. transmit
- content or material provided via the Service, or authorise or assist anyone else to do so.
6. TAW’s standard of service
6.1. TAW will make reasonable efforts to keep the Service operational at all times.
6.2. Technical difficulties may result in temporary interruptions to the Service.
6.3. No interruptions to the Service shall entitle you to a refund of any payment already made by you.
6.4. TAW is under no obligation to produce a minimum number of shows per month.
7.1. Nothing in these Terms of Service limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other matter that we cannot exclude or limit as a matter of law.
7.2. To the extent permitted by law, TAW excludes all conditions, warranties, representations or other terms which may apply to the Service or any content on it, whether express or implied.
7.3. Except in the case of events falling under clause 7.1 above, TAW liability for any loss or damage caused by the Service, including (but not limited to) any loss or damage caused by errors, viruses or bugs arising in the Service or from your use of the Service, shall be capped at the Subscription Fee paid by you.
8. Changes to these Terms of Service
8.2. Please check this page from time to time to take notice of any changes we made, as they are binding on you.
9. Your account and use of the Service
9.1. You must treat your account details, including your password, as confidential, and not disclose them to any third party.
9.2. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at firstname.lastname@example.org
9.3. You are responsible for any activities that occur under your account. We shall not be liable to you or any third party for any loss or damage which may arise as a result of any failure by you to keep your password or account confidential.
9.4. You will be able to add comments to some parts of the Website and the Service. TAW does not moderate comments strictly. However, TAW does maintain the right to remove comments which it deems offensive (“Offensive Comments”), and to suspend or terminate accounts which post Offensive Comments.
11. Governing law and jurisdiction
11.1. These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
11.2. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Service or its subject matter or formation (including non-contractual disputes or claims).
12. No reliance
12.1. The content provided via the Service, and any content which can be downloaded from the Service, is provided for general information only.
12.2. Although TAW makes reasonable efforts to ensure that information provided is accurate and up to date, TAW makes no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.
13. Entire agreement
13.1. These Terms of Service together with the following documents make up the entire agreement between the you and TAW, and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter:
